America’s Mobile Lifetime Unlimited Plan – Terms & Conditions
1. Plan Overview
America’s Mobile offers a Lifetime Unlimited Talk, Text, and Data Plan for a one-time payment of $3,000. This plan provides unlimited domestic talk, text, and data on a nationwide 5G/4G LTE network.
2. Definition of “Lifetime”
The Lifetime Plan applies to the individual customer for their lifetime. However, for the purpose of business continuity, acquisitions, or unforeseen circumstances, America’s Mobile guarantees service for a minimum of 30 years. If the company is acquired, the new owner must either honor the plan or offer a pro-rated refund based on the time used, with the first years being more valuable than later years.
3. Network & Carrier Policy
This plan operates on a nationwide carrier’s network; however, America’s Mobile is prohibited from advertising the carrier’s name.
In the event that the underlying carrier discontinues service, America’s Mobile will transition customers to an alternative carrier. No refunds will be provided in this case.
Data speeds may be subject to network management policies, including deprioritization in congested areas.
4. Non-Transferability
This plan is strictly non-transferable and may not be assigned, sold, or shared with another individual or entity.
5. Fraud Prevention & Verification
America’s Mobile reserves the right to verify that the customer is still alive and that the service is not being used by an unauthorized individual.
Any attempt to circumvent the verification process, commit fraud, or engage in identity misrepresentation will result in immediate termination of service without refund.
6. Compliance & Fair Use Policy
Customers must use the service in accordance with all applicable local, state, and federal laws.
The plan is intended for personal use only. Resale, leasing, or commercial exploitation of the service is strictly prohibited and may result in termination without refund.
Excessive usage patterns indicative of abuse may result in investigation and possible suspension or termination.
7. Customer Cooperation
Customers must cooperate with America’s Mobile in resolving service issues, including but not limited to performing troubleshooting steps or submitting required documentation upon request.
8. Service Guarantee & Refund Policy
The plan includes a 30-year service guarantee.
If America’s Mobile is acquired within 30 years, the acquiring company must either continue the service or provide a pro-rated refund based on time used, with higher value assigned to earlier years.
If America’s Mobile ceases operations within 30 years, customers will be eligible for a pro-rated refund.
Refunds will be calculated based on a declining value scale, where the first five years are valued higher than subsequent years.
Business Closure or Bankruptcy Policy: In the unfortunate event that America’s Mobile ceases operations or undergoes bankruptcy, we will make every reasonable effort to transition customers to an alternative provider. However, if no viable alternative is available, refunds may not be possible due to financial constraints. Customers acknowledge that the Lifetime Plan is contingent upon the continued operation of America’s Mobile.
9. Governing Law & Dispute Resolution
All legal matters will be handled exclusively in San Diego, California.
Any disputes must be resolved through binding arbitration rather than litigation.
10. Force Majeure Clause
America’s Mobile is not liable for service disruptions caused by events beyond its control, including but not limited to natural disasters, government actions, or regulatory changes.
11. Indemnification Clause
Customers agree to hold America’s Mobile harmless against any claims arising from their use of the service, including but not limited to third-party claims, regulatory disputes, and service limitations beyond America’s Mobile’s control.
12. Modifications & Amendments
America’s Mobile reserves the right to amend these terms as necessary to comply with regulations or business continuity needs.
Any significant modifications will be communicated to customers via email or through official company channels.
13. Fraud Monitoring & Account Verification
America’s Mobile reserves the right to periodically review account activity and request verification at any time to prevent fraud or unauthorized use.
Failure to comply with verification requests may result in suspension or termination of service without refund.
14. No Resale or Commercial Use
This plan is intended for personal use only.
Any attempt to resell, lease, or commercially distribute the service is strictly prohibited and may result in immediate termination without refund.
15. Device & SIM Card Policies
The service is only available on approved devices.
Lost or damaged SIM cards may require a replacement fee determined by America’s Mobile.
16. Customer Responsibility
Customers are responsible for maintaining their service and ensuring compliance with these terms.
Failure to adhere to these policies may result in service termination.
